Who we are

SlingShot Effect Limited is a company registered in England with registered office at The Barn, Etloe, Blakeney, Gloucestershire, GL15 4AT and company registration number 06673688. In these terms and conditions references to "SlingShot", "we", and "us" mean SlingShot Effect Limited.

Your agreement with us

We operate various games. To participate in any of our games you must complete and sign a paper registration form (or, if you are registering for a game online, complete an online booking form and tick the relevant acceptance box) to confirm you agree to these terms and conditions and any game-specific rules and instructions (which together form a legally-binding agreement between you and us). These terms and conditions include important information about who we are, our obligations to you, and your obligations to us and other people. We draw your attention particularly to paragraphs 6, 8-11, 13 and 18. If you do not agree to comply with the agreement between you and us you must not participate in any of our games. Please note that no amendment you make to these terms and conditions or any game-specific rules or instructions will be effective unless we specifically agree to it in writing.

  1. Registration and enrolment in games 

    To participate in any of our games you must complete and sign a paper registration form (or, if you are registering for a game online, complete an online booking form and tick the relevant acceptance box). If you are under 18 years of age a parent or other appropriate adult must do this for you. By doing this you confirm (either for yourself or for the person on whose behalf you complete a registration form) agreement to: (a) these terms and conditions; and (b) any game-specific rules and instructions (which may be provided before or after completion of a registration form).

  2. Registering online.

    If you register for a game online we will send you an e-mail acknowledging we have received your registration. Your registration is an offer to us to buy a place on a game. All registrations are subject to acceptance by us. If we accept your registration we will confirm acceptance by sending you an acceptance e-mail. A contract between us will only be formed when we send you that acceptance e-mail.

  3. Participants under 18 years of age

    Unless we specifically state a game is open to children (that is, those under 18 years of age), you must be 18 years or over to play any of our games. Where we have stated a game is open to children, a parent or appropriate adult must determine whether that game is suitable before allowing the child to participate. Children must at all times be accompanied by a parent or appropriate adult who must supervise that person's involvement, including their interaction with other players, game officials, and the public, as we cannot do so.

  4. Changes to game rules and designs

    We reserve the right to make changes to game rules and game designs at any time. Therefore, games may have different game rules or designs to those advertised before their start. We will notify you of any such changes either through written or spoken instructions. Normally these changes will be for health and safety, risk management or related reasons. If you no longer wish to participate in a game following a change to game rules or game designs you should notify us before the start of the game and we will issue you with a replacement ticket for another game or a refund. Providing a replacement ticket or refund will be our sole liability to you in these circumstances.

  5. Our game locations

    Our games are designed to be played in open public spaces. While we may stipulate where a game may start or finish or particular locations throughout the game, we do not supervise you directly when playing our games or determine how you get between locations or to the finish.

  6. Your behaviour during our games

    When playing our games you are responsible for ensuring that you do not put yourself or others at risk of injury or harm. For example, you must not play a game in the vicinity of hazards, you must not climb buildings or obstacles, and you must take particular care when crossing roads and playing near moving vehicles. 

    You must not play a game or any part of it in or on any privately owned property without the consent of the owner of that property. You must not use without consent or damage property belonging to anyone else (including, but not limited to, buildings and vehicles).

    You must not play a game in a way that threatens, intimidates, harasses, demeans or bullies any other participant, any game official, or any member of the public, or in a way that is otherwise unlawful.

    If you breach any of the terms of your agreement with us, including particularly the obligations set out in this paragraph, we may prevent you from joining a game (if a game has not already started) or continuing in a game (if a game has started). In these circumstances we will not provide you with a refund or allow you to participate in an alternative game, and will have no further liability to you.

  7. What to do if you experience a problem when playing our games

    If you see any person or property being put at risk when playing a game, or if you see a game being played in a way that is contrary to these terms and conditions or any game-specific rules or instructions, you must tell one of the organisers as soon as possible (even if that means interrupting your participation in a game).

  8. Our right to suspend or cancel our games

    We reserve the right to suspend or cancel a game at any time for any reason including, but not limited to, for bad weather or where we believe that any person or property may be harmed if a game continues.

  9. Your rights if we suspend or cancel our games

    If we suspend or cancel a game and the reason for the suspension or cancellation is not your fault we will offer you a ticket to participate in another of our games or a refund of the ticket price. Providing a replacement ticket or refund will be our sole liability to you if we suspend or cancel a game.

  10. Your right to cancel a booking

    If you make a booking online or by telephone you may cancel your booking and receive a refund of any amount you have paid without charge within 7 working days of making your booking, provided the game has not already started.

    If you cancel: (a) a booking made in person at any time; or (b) a booking made online or by telephone more than 7 working days after making it, we will give you a refund of the ticket price less an administration fee of £4.20 plus 4.5% of the ticket price and any postage charges. This reduction is in respect of our costs incurred in dealing with your booking and cancellation. In either case we will only give you the refund if you cancel at least 30 hours before the game is due to start, unless we are able to resell your ticket before the game starts.

  11. Refunds

    In all cases where we make a refund we will process the refund as soon as possible and always within 30 days of notice of cancellation (where you are automatically entitled to a refund) and 30 days of agreement to issue a refund (where a refund is in our discretion). We will usually issue a refund using the same method you used to pay.

  12. Games which require use of mobile phones or other electronic devices

    Where a game requires you to use a mobile telephone or other electronic device, we will identify before the start the types of devices that will be suitable for use. We cannot be held responsible if your device is not suitable for a game, or for any limitation of or defect in that device or any communication link or service.

  13. Safety of your personal belongings

    If you carry personal belongings or valuables with you when you play a game, you must take the same precautions to safeguard them as you would if you were in the place where a game is taking place but not participating. If a game is in an area you do not know you should familiarise yourself with the area before its start. If you leave your personal belongings or valuables with us we do not accept any liability for loss or damage unless we have failed to provide security measures which we told you we would provide or have otherwise acting negligently or dishonestly with regard to those personal belongings or valuables.

  14. Travel during our games, your fitness and equipment

    Our games often require players to travel some distances across a town or city. You must ensure that you are fit and well enough to play our games by reviewing the game rules and game designs prior to registering, and that you wear appropriate clothing and footwear. We will not reimburse you for and will not otherwise be liable for any travel or other costs you incur when playing a game, or if your ability to participate in a game is limited because you wear inappropriate clothing or footwear.

    If you have any health or mobility issues that may impair your participation in a game, you can contact us in advance through our website, http://slingshoteffect.co.uk/talktous. While we cannot give you advice specific to your personal needs, we can give you more general information about how a game can be played to help you decide whether you would like to participate. We will not be liable to you if your ability to participate in a game is limited by your health or mobility issues unless we have advised you incorrectly that a health or mobility issue of which you have notified us will not prevent you from participating in a game.

  15. Consent to use of your image

    Your hereby consent to the recording by still or moving image recording equipment of your image during your involvement in our games and you hereby consent to the use without payment of any such recorded still or moving image to publicise us, any of our events, and/or any of our partner organisations, and for any ancillary purpose, anywhere in the world, in any medium, for all time.

  16. Use of your personal information and privacy

    We will use personal information you give to us when registering for a game only for the purposes of administering your participation in that game, but not for any marketing or other purposes. You must ensure that the information you provide to us is accurate and complete.

  17. Our liability to you

    (a) While we take care in designing our games to limit the risks involved in playing them, any game which involves physical activity involves some risk.

    (b) You recognise that we cannot eliminate risk in our games entirely and that if you breach these terms and conditions or do not follow game-specific rules or instructions you are likely to expose yourself to additional risk. Accordingly, we will not be liable to you for any loss or damage you suffer to the extent it arises out of your breach of these terms and conditions or your failure to follow any game-specific rules or instructions.

    (c) If you suffer any loss or damage because we breach these terms and conditions or otherwise act negligently towards you we shall only be liable to you to the extent that we could, at the time you enter this agreement, reasonably foresee the loss or damage you suffer.

    (d) Nothing in these terms and conditions, however, operates to limit or exclude our liability for death or personal injury caused by our negligence or for fraud, or any other liability that cannot lawfully be excluded.

  18. Governing law and courts

    These terms and conditions shall be governed by and construed in accordance with the law of England and Wales. Any dispute arising under or in connection with these terms and conditions and your participation in any of our games shall be subject to the exclusive jurisdiction of the courts of England, to which you and we irrevocably submit.
